- The client assures that he is the owner of the items handed over or is entitled to dispose of them freely and that these items are not encumbered with a lien or any other right vis-à-vis third parties.
- The auctioneer acts in the name of another and on behalf of the consignor on the basis of the auction conditions, which are part of this contract. The consignor undertakes to maintain his offer until the end of the auction. If he withdraws his auction order, he is liable for lost consignor and buyer commissions, whereby the estimated price is the basis. Bids for single-lots are charged at a flat rate of 100 euros, bids for collection are charged at a flat rate of 500 euros estimated price. Withdrawal from the auction contract is only legally effective if the lost commission is paid at the same time.
- The auctioneer receives a commission of 20% of the auction proceeds from the client. The auctioneer receives 0.5% of the starting price for insurance and the costs associated with securing the items consigned. Any costs incurred for the inspection of individual items by an expert inspector are charged separately. The commission and other additional services are subject to the current statutory VAT.
- All stamps/coins that have not yet been checked for authenticity can, if necessary, be checked and marked by authorized specialist inspectors in order to largely rule out later complaints from the buyer. Items that have been clearly identified as counterfeits can be marked as such by the inspectors. Within the statutory limitation period, the consignor is liable to the auctioneer for claims on the part of the buyer arising from justified complaints in accordance with the provisions of sales law (§434 ff. BGB).
- The client leaves it up to the auctioneer to decide how he divides or combines the lots based on his experience and at what level he sets the estimated prices. If the auctioneer sets estimated prices, he is entitled to knock down lots approximately 20% below the estimated price without consulting the client. Higher bids will only be accepted with reservations and the knockdown will only be made if the client has agreed. There is no limit on the number of consignments. Suitable estate items can be offered in the separate estate section of the catalogue on request in order to attract special attention and viewing intensity. For business reasons, a consignment should have a minimum total starting price of 1,000 euros, single-lots should not have a starting price of less than 50 euros, and collections should not have a starting price of less than 100 euros. Lots without starting price should also have a knockdown expectation of at least 50 euros/100 euros.
- Lots that are not sold during the auction can be sold by the auctioneer until the final settlement after the auction under the terms of the auction order and in accordance with the auction terms and conditions.
- The material submitted for auction is treated with the utmost care as entrusted goods and is stored in specially secured rooms, armored and safes. Transport and storage of the auctioned goods are at the risk of the client. The material submitted is insured by the auctioneer against the usual risks of transport and storage at the auctioneer and in the auction premises. The material submitted remains the property of the client until full payment by the auctioneer.
- The consignment is settled after receipt of money and after the expiry of the complaint period 30 working days after the auction. Payments of the proceeds are made to the consignor or an account specified by him. Payment is made subject to the auction customer paying his invoice. Gold and/or silver items can be sold for less than their gold or silver value (Valuation Regulation §1 No. 6, lit. c).
- After the purchase agreement has been concluded, the name and address of the respective contractual partner will be disclosed to the consignor and the purchaser upon request. The statutory VAT will be charged on the commission and any additional costs.
- If an advance payment granted to the consignor is not covered by the auction proceeds, the difference must be repaid by the consignor no later than three weeks after the auction.
- The place of performance and jurisdiction, including for a possible contractual reversal, is always Hildesheim for all parties involved. The terms of this contract also apply to all future consignments, unless a new contract is concluded. There are expressly no verbal promises or ancillary agreements.
